Advice of Rights

Advice of Rights

IF YOU ARE BEING ASKED QUESTIONS WHICH COULD RESULT IN DISCIPLINE, DO THE FOLLOWING:
1. Request a Union representative to be present before answering any questions.
2. Keep your answers to the point and very accurate. Be narrow and direct.  Answer truthfully, but do not speculate, and do not ramble on.
3. Make sure you are directly ordered under pains and penalties of termination, to answer the questions. Request your Garrity Rights.  Do not volunteer information.
4. Do not volunteer to take a polygraph examination, alcohol or drug test. Contact a Union representative immediately if you are requested to volunteer to take any of these tests.
5. If told you are or may be facing a disciplinary investigation, refuse to answer any questions until you have spoken with a Union representative or Union attorney.
6. ASK if you are unsure if the questioning can lead to discipline. ASK for representation.  DO NOT refuse to obey a lawful order, but do verbalize your opposition.

YOU MUST ASSERT YOUR RIGHTS
1. You do not have to agree to be tape recorded. It is unlawful in New Hampshire to be tape recorded without your permission.
2. You have a right to assert your right against self-incrimination. Please ensure that you receive your Garrity Rights.
3. You have a right to review and obtain a copy of all of the evidence compiled against you. Request it.
4. You have a right to be informed of the charges against you. Ask for a detailed explanation with reference to any policies. Request a copy of the policy.
5. Request that all Management notes and minutes be kept and not destroyed and that you be provided with a copy.
6. You have a right to a Union representative of your choice. Ask for the representative before answering any questions.
7. Do not volunteer information unless you have spoken to your Union representative.
8. Do not volunteer to take a polygraph examination or a drug test without the advice of counsel.
CAVEAT
I am making this statement for administrative purposes only.  I have not done so voluntarily, but in compliance with a direct order of a supervisor, under the pains and penalties of termination.  This in no way constitutes any waiver of any of my rights that may be based on any source.  This statement or any part thereof, or any fruits of this statement may not be used against me in any subsequent criminal proceedings.
